The Gage County Board of Supervisors on June 25 directed the county attorney to contact the bonding company for the contractor Voidscapes after lengthy delays left several structures uncompleted on a county paving project.
Board members recounted the contract’s timeline: the job was bid in April 2024 with an original completion date of Nov. 1, 2024; the contractor received extensions through May 1 and June 1, 2025; and the county said work remains unfinished as of June 25. County staff reported five structures still required work, with two definitively open and one more likely to be opened shortly.
Supervisors discussed liquidated damages written into the contract (applied per structure per day), the consequences of making a formal bond claim and the county’s preference to see the project completed rather than immediately replace the contractor. Several supervisors described hardship for local residents and agricultural users who lost a year of harvest access because roads remain closed.
County legal counsel recommended first contacting the bonding company’s attorney to explain the situation and give the bonding company an opportunity to arrange completion, reserving formal bond claims if negotiations fail. Commissioner Adams made the motion to have the county attorney contact the bond company; Commissioner Claybaugh seconded the motion. The motion passed 5–1, with Commissioner Dorn voting no.
Board members asked staff for the bonding company’s contact information and directed the county attorney to follow up with counsel for the bonding company. The board emphasized a goal of getting the roads reopened quickly while preserving the county’s contractual remedies.
