The Needham Board of Health on Thursday adopted a revised regulation that narrows how oral nicotine pouches may be sold in town, voting to approve language that requires both an adult-tobacco-store restriction and flavor/amount limits rather than one or the other. The regulation change was adopted after a public hearing that produced no in-person comments.
The change amends Article 1, section g of the Board of Health’s tobacco regulations to add a second subpoint so that nicotine pouches would be subject to both location-based restrictions and limitations on flavors and maximum nicotine per unit. Amy (chair, Board of Health) opened and closed the public hearing and directed discussion toward the draft language before the vote.
Board members said the amended phrasing — replacing an “or” option with “and” — was intended to ensure that if an adult-only tobacco store were to open in town, that business would still have to comply with flavor restrictions and limits on amount per product. Steven (board member) summarized the suggested edit as changing the disjunctive option to a conjunctive one so both conditions apply. Tara (staff member) confirmed the amendment is within the scope of the notice that ran in the newspaper twice.
There was no written public comment submitted in advance of the meeting, and no attendees raised hands to speak during the live public hearing. After brief technical edits and an effective date to be inserted, the board voted to adopt the regulation as proposed with the “and” amendment.
The board recorded affirmative votes from Steven, Ed, Arpi, Rob and Tejal during the roll call. Staff said minor technical edits (including the exact age language and the effective date) will be inserted before the regulation is finalized and published.
The board’s packet included the previously posted legal notice; staff said the newspaper initially published a notice labeled for the select board by mistake and reran the Notice correctly for the Board of Health for two consecutive weeks prior to this meeting.
The regulation will be published after staff transcribes the final technical edits and inserts the effective date. The board did not create or adopt additional enforcement procedures during the meeting beyond the regulatory language itself.
