Public Works committee approves retaining-wall work at 841 Sylvia Drive, contingent on indemnification

The Public Works Committee on Aug. 4 approved permission for work in the public right of way at 841 Sylvia Drive, contingent on a city indemnification agreement. The committee voted 5-0 to allow the property owner to replace an existing retaining wall that an inspector found encroaching into the right of way.

The item matters because structures that extend into the right of way can affect city maintenance and liability; the committee conditioned approval on execution of an indemnification agreement to address those risks.

Committee members said the wall replacement began without a separate right-of-way permit after the owner started replacing an aging crosstie wall. An inspector visiting the site while checking an unrelated poured-concrete permit in the rear of the house determined part of the replaced wall extended roughly 1 foot into the right of way. The property owner stopped work and sought committee approval and an indemnification agreement.

Committee members described the site as on the corner of a horseshoe-shaped portion of Sylvia Drive, with steep topography that makes the wall necessary to prevent runoff or slope failure onto neighboring property. The wall on the parcel had been constructed originally with crossties, likely installed in the 1960s; the replacement work uses poured concrete.

A neighboring resident expressed support for continuing the wall replacement, and the presenter said the majority of existing shrubs screening the wall have remained. The committee moved to approve the work as agenda item 240725, with the condition that the city receive a proper indemnification agreement before completion.

The minutes-approval motion earlier in the meeting (for July 21) passed 5-0. For the Sylvia Drive item, Councilor Simms made the motion to approve the right-of-way work with an indemnification agreement; Councilor Gere seconded. The committee voted unanimously in favor.
