Council designates city manager to approve subdivision plats after state law change

The DeBary City Council adopted a resolution Aug. 6 delegating administrative authority to the city manager to approve subdivision plats and replats, aligning the city’s practice with a recent amendment to state law.
City staff explained that Senate Bill 784 (chapter 2025-164) amended Florida Statutes §177.071 on June 20, 2025, changing the procedure for final-plat approvals from governing-body action to administrative approval. Under the new law, the governing body may designate an administrative official to receive, review and approve plats by ordinance or resolution.
The resolution designates the city manager as that administrative official and authorizes the manager to approve or deny plats under §177.071, to impose conditions consistent with §177.091, and to delegate review duties to appropriate growth-management staff or other departments. The council vote was unanimous.
Council member Stevenson voiced reservations about the loss of a home-rule process but supported the designation as an appropriate administrative step in light of state law. Staff said the city manager could further delegate the technical review workload to growth-management staff while retaining final administrative authority under the resolution.
