Smyrna’s council approved a resolution conveying an unimproved portion of public right‑of‑way known as Milesdale Lane to the Preserve at Stewarts Creek Homeowners Association.
Planning staff said the right‑of‑way was dedicated during the neighborhood’s development but never improved; it was intended to allow a future connection but was not built after adjacent property owners expressed concern about cut‑through traffic. The HOA requested a quitclaim so the land can be incorporated into the community’s common area as an amenity space.
Staff confirmed Consolidated Utility District holds a water line within the right‑of‑way and the town will preserve a 30‑foot utility easement for that line. Planning commission reviewed the request and found it consistent with the comprehensive plan; staff recommended approval.
Council approved the conveyance; the decision removes the unimproved ROW from the town’s maintenance responsibility and transfers ownership to the HOA while retaining the utility easement.
