Council approves license agreement for 201 Broadway; township to put adjacent parcels to bid

A resolution authorizing the mayor and business administrator to execute an agreement with Vincent and Stacy Meli concerning the property at 201 Broadway was approved by the Township of Clark council.

Resident John Greaves asked at the meeting, "What kind of agreement is it? Is it a sale? Is it a rental? And I guess, what would the town be doing with the property?" Business Administrator Jim Ulrich replied: "there's a property on Broadway that has 2 pieces it's surrounded by 2 pieces of property that the township owns. There is an encroachment on the property, so what we're doing is we're giving them a license to, you know, use the property and not have to take, any of the, encroachments off, and we're also putting it out to bid. There's no guarantee that they will get it as part of the bid, but we are going to put out those 2 pieces of property to bid."

Ulrich also told the council that the Melis will provide insurance naming the township as additional insured for the properties. The council adopted the authorization by roll call; one member recorded an abstention during the vote (recorded in the meeting transcript as "Council member Hund" asking to abstain). No sale or final conveyance was recorded at the meeting; the council's vote authorized execution of the agreement and staff to proceed with the public-bid process for the township-owned parcels.

The item was discussed during the council's resolutions portion and the clerk recorded the roll-call votes. The council did not adopt a sale ordinance at the meeting.
