The city attorney informed the commission about a law firm's proposal to challenge Senate Bill 180 on constitutional grounds, describing it as a coordinated, multi-community approach.
“I spoke about Senate Bill 180 and how it was usurping so much from home rule,” the city attorney said, and described a well‑drafted suit prepared by a law firm (transcribed as “Weiserota, Healthman, Cole and Bierman”) seeking 10 participating jurisdictions and an initial deposit of $10,000 to pursue the case.
Commissioners asked whether the commission could act immediately. The city attorney said joining would require a deposit with the firm, and offered to draft a resolution for the commission to consider if the commission wished to participate. No motion or vote to join the litigation was taken at the meeting; the commission did not commit funds. The city attorney noted larger communities might lead the effort and that smaller municipalities could decline depending on budget considerations.
The commission did not take formal action but asked the attorney to prepare material should the commission decide to consider participation at a future meeting.
