The Board of Health voted Aug. 5, 2025, to continue public-nuisance orders on two properties — 44 North Center Street and 193 High Street — after both changed ownership and the Department of Health asked the board to keep existing orders in place. The actions preserve the board's prior findings and give the new owners notice and an opportunity to appeal.
The continuation request for 44 North Center Street traces the property's nuisance history back to an order dated Oct. 25, 2022, while the property was owned by Duane Wirtz. Department staff told the board that the parcel transferred by quitclaim to a new owner on July 10, 2025, and that recording was reported on July 11, 2025. The department asked the board to continue the order under which the property remains subject to remediation requirements.
City staff made a similar request for 193 High Street. According to the record presented to the board, that property was declared a public nuisance by order dated March 25, 2025, and was conveyed to D and H Home Repairs and Property Rentals LLC on July 1, 2025 (recorded July 2, 2025). Department staff asked the board to continue the existing order against the new owner.
In both matters board members moved and seconded motions to continue the public-nuisance orders; the board then took roll-call votes. For 44 North Center Street the roll call recorded in the meeting transcript shows affirmative votes from Board member Gall, Board member Locust, Board member Rios and Board member Sephora and the presiding official. For 193 High Street the transcript shows affirmative votes from Board member Goff, Board member Lopez, Board member Rios and the presiding official. The motions as recorded passed.
Staff told the board that continuing an order places the new owner on the same timeline for notice and appeal that applied to the prior owner; if the new owner does not file an appeal after receiving notice, the department may proceed under the existing order.
The board did not adopt additional deadlines or new remediation plans at the meeting for these two properties; the continuation orders maintain the prior findings and leave remediation details to the department and any future appeals or compliance inspections.
