The BMZA postponed Aug. 5 consideration of an application to use 2033 Eastern Ave (the former Burger King site) as a principal parking lot after staff advised the property has an outstanding vacant‑building notice. Planning and code‑compliance staff told the board they could not process a conditional‑use application while an unresolved violation remained on the property.
Attorney presenting for the applicant said the owner has been pursuing a new permitted use and that the proposed parking operation would not alter the vacant buildings. The board noted the zoning code contains a provision preventing processing of conditional‑use applications where unresolved code violations remain and that the housing division must confirm abatement or documentation sufficient to allow processing. Board members asked the applicant to work with housing/code enforcement and indicated they would postpone the matter until the property’s vacant‑building notice is resolved or otherwise addressed. The applicant agreed to coordinate with the housing department and return with clarification of the violation’s status before the board takes further action.
