BMZA to schedule hearing after timely request for reconsideration in Old Hamilton Avenue case

The Baltimore Municipal Zoning Appeals board agreed Aug. 5 to schedule a hearing on a timely request for reconsideration in case BMCAPL25-0175107 (Old Hamilton Avenue). The board did not grant a rehearing at the general meeting but instructed staff to calendar a regular-docket hearing limited to the issues raised in the motion for reconsideration.
The board discussed the standard for reconsideration and the options available to it. Executive Director Becky Witt reminded members that “a request to reconsider is not a do over,” and listed the grounds the rule requires — including fraud, mistake, clerical error, or newly discovered evidence — before turning the procedural choice to the board.
Board members said they wanted more time to review the original record before deciding whether to hold argument. Chair Leland Shelton and other board members said they were inclined to schedule a separate hearing so the appellant and applicant could present testimony and argument specific to the motion. The board directed staff to set a date on an upcoming docket and to limit the scope of any future hearing to the items raised in the motion for reconsideration.
No formal vote on the underlying zoning decision was taken at the Aug. 5 general meeting; the board instead set the procedural next step. The board also noted that the applicant’s response to the motion had been provided and that Charm TV was present for the public proceeding.
