Lebanon BZA approves setback variance for Pennington barn reconstruction

The City of Lebanon Board of Zoning Appeals on Aug. 4 approved a setback variance to allow the reconstruction of an accessory barn at 3310 South Indianapolis Road in the same footprint, size and shape as the existing structure.
City planning staff explained the property is zoned R-1 single-family residential, where accessory structures generally must meet a 15-foot side setback and cannot be located in front of the primary structure. The existing barn sits close to the property lines on a triangular lot that staff said offers no practical alternative location for a replacement that would meet the ordinance.
Staff concluded the proposed replacement would not be injurious to public health or adjacent property values because the new structure would occupy the same location as the existing barn and has not caused prior issues. Staff recommended approval of front, side and rear setback relief limited to a structure of the same size, shape and location as the existing barn.
Applicant William Pennington described the planned structure’s height: “Roughly 14 feet in the front and, like, 9 9, 10 feet in the back,” he said. The board opened a public hearing; no members of the public spoke.
The board voted to approve Docket 25-33 with the staff condition that the proposed barn be the same size, shape and location as the existing barn. Roll-call exchanges in the record show board members Bruce Polley, Ron Edwards and Corey Gross registered affirmative votes during the roll call for the motion; the chair announced the motion carried.
The variance authorizes Pennington to reconstruct the accessory structure in its existing footprint; any change beyond the same size and location would require additional review. The board did not place operational conditions beyond the size/shape/location limitation. The board’s next meeting was scheduled for Sept. 2.
