Liberty Utilities’ notice of intent to install a gas main under Jefferson Street near C3 Pond was not opened by the Fall River Conservation Commission on Aug. 4 after staff identified multiple application deficiencies and the applicant did not appear.
Conservation staff told the commission the filing lacked the property owner signature from Spectrum Lighting and did not acknowledge that the project crosses City of Fall River property beyond the street, a matter that requires the city’s signature. Staff also flagged missing fees, incomplete plan detail (topography and a mapped stream classification) and an absent contact for the consultant shown on the filing. The conservation agent asked Liberty representatives to resolve the items and obtain a DEP file number that would trigger an external review.
The agent noted that an applicant may not proceed without proper owner signatures and a DEP file number because DEP comments can identify substantive permit deficiencies; staff recommended tabling the matter until the applicant corrects the submission. The commission moved to table the item for one month.
No vote on the merits of the project was taken. The agent said the applicant’s consultant and Liberty will need to show whether the stream in the area is perennial or intermittent and, if perennial, supply information on work within the 25‑foot riverfront area. The record also shows Benjamin Phillips no longer works for Liberty Utilities and staff attempted to reach other contacts listed in the filing.
