Resident asks commission to exempt legacy Gulfview Harbor from mandatory sidewalk rule

A Gulfview Harbor homeowner asked the commission to consider amending the city’s land-development regulations so that legacy neighborhoods with impractical conditions can obtain waivers from a mandatory sidewalk-installation rule. Deanna Brinkman, who identified herself as a resident of Gulfview Harbor, told commissioners the Land Development Regulations (LDR) Chapter 4, Section 8, Subsection 3(d), requires sidewalk installation whenever a parcel is improved or occupancy classification changes. She said an FPL transmission transformer on the corner of her property makes building a sidewalk impractical and that no other homes on her street have sidewalks. Brinkman said she asked for an administrative waiver through engineering and planning but was told the code does not allow it. "I'm proud to be improving my home and investing in this city, but I believe this code, as currently applied, creates a disproportionate burden in certain areas," Brinkman said. She asked the commission to consider adding administrative flexibility in legacy neighborhoods so residents could get waivers or variances in appropriate circumstances. Commissioners asked staff for more information. During later discussion of board-appointment procedures and scheduling, Commissioner Kelly asked that the sidewalk request be placed on a future agenda for research and background information. City staff noted that code and ordinance amendments require a formal process and that some items will require changes to the ordinance language. No formal action was taken at the meeting; commissioners asked staff to research options, including whether an administrative waiver, variance, or ordinance amendment would be required and to return with background at a future meeting.
