Board rejects immediate addition of TOSA positions to agenda; item set for July 19 study

Board member Sean Butler asked the Greece Central School District Board of Education to add reconsideration of TOSA (Teacher on Special Assignment) positions to Thursdays agenda, saying the district would need time to react if the positions were restored before school starts.
"I'd like to add consideration of the TOSA positions that were eliminated 2 meetings ago to reconsideration of that to the agenda," Butler said during the agenda-setting portion of the meeting. The board president ruled Butlers request out of order, saying the item had not been added properly and that the board should avoid last-minute additions.
Butler sought to appeal the presidents ruling. The appeal was seconded and put to a vote; the motion to overrule the chair failed. After the failed appeal, the president and other trustees said the item would be added to the boards July 19 meeting so trustees could have time for legal review and for the district to prepare study materials.
The president said there were legal questions that needed answering before the board could discuss reinstating the positions. "I have a couple legal questions that I'm gonna need answered beforehand because I think there's some, there's a potential per violation that occurred here and that we could be committing a per violation as a district for direct dealing," the president said, adding that assistant superintendent Larson was not in a position to answer those questions that night. Butler said the timing was urgent if the positions were to be effective for the start of school.
Board member Mister Mongereal asked whether the board would receive a study session prior to the July 19 meeting; the president responded that a study session would occur at some point but not in time for Butlers requested date. Trustees agreed to schedule a fuller discussion at the July 19 meeting when the relevant legal and staffing information could be prepared.
The record shows Butler appealed the chairs ruling and the appeal vote failed; the board did not take formal action to reinstate the positions at the meeting. The discussion was procedural in nature and will be revisited when staff can provide legal guidance and a study packet for trustees.
