Board sets Aug. 18 public hearings for Starlight Lodge, Bailey Estate and a shed/garage encroachment

The County Drainage Board set public hearings for Aug. 18 on three matters: Starlight Lodge Subdivision’s encroachment request into a regulated drain easement, the Bailey Estate Subdivision and a homeowner’s request to move a shed and build a garage within a drain setback.
Starlight Lodge Subdivision: Elaine Phillips presented a one‑lot Starlight Lodge Subdivision of 2.13 net acres. Phillips said the perimeter drain would outlet into the William Johnson regulated drain through an easement to be granted by a nearby landowner; the applicant requested a 15‑foot encroachment into the drain easement. A neighboring owner said equipment access to the drain requires passing through the applicant’s yard and asked that the owners be fully informed about dredging activity and spoils placement; Phillips and staff said the county regularly accesses the 75‑foot easement for cleaning and that the easement would preserve that right. The board voted to set the Starlight Lodge item for public hearing on Aug. 18.
Bailey Estate Subdivision: Surveyor Rudy Bugdiveen (Randall Miller & Associates) presented the Bailey Estate one‑lot subdivision (4.36 acres) with an outlet to a tile leading to the Eli Shrock Ditch. County staff asked whether the project qualified as an over‑one‑acre disturbance for stormwater permit (SWPPP) requirements; Bugdiveen said the proposal is an individual lot disturbance of less than one acre, and staff advised the applicant to consult the county stormwater coordinator on the correct permit type. The board set the Bailey Estate matter for public hearing on Aug. 18 at 5:00 p.m.
Jose Prado encroachment: Homeowner Jose Prado requested to move a 16‑by‑16 shed and build a 25½‑by‑24‑foot garage that would keep the same separation from the county tile as the existing shed (staff measured the existing shed at 33.4 feet from the county tile). Staff said they will notify adjacent owners and set the item for public hearing on Aug. 18.
Why it matters: The public hearings will let neighbors testify and will determine whether the board will permit temporary or permanent encroachments into regulated drain easements and whether proposed development complies with drainage and access needs for regular ditch maintenance.
Board direction: For encroachment requests, staff emphasized the county’s continued right to enter easements for dredging and maintenance and told applicants to ensure property owners understand the visual and physical impacts of drain maintenance. For Bailey Estate, staff recommended the applicant coordinate with the stormwater coordinator to confirm the appropriate permit type.
Next steps: All three items were set for public hearings on Aug. 18; staff will notify adjacent property owners and the applicants of the hearing dates and any documentation the board requested in advance.
