The administrative law judge recommended a 180‑day suspension followed by five years of probation under Board Rule 281.64; staff prepared a proposed board order consistent with that recommendation.
Board members had no additional substantive questions about the facts. A motion to adopt staff’s recommendation was made by Donnie and seconded by Ian. The motion carried in open session with no recorded opposition. John noted that Board Rule 281.60(b) reserves final sanction decisions to the board and that the board is not bound by an ALJ recommendation.
