The policy committee reviewed updates to Policy 827, the district’s conflict-of-interest and operations policy, and raised two principal concerns: disciplinary language that applies to employees but not to elected board members, and a broadly worded definition of “honorarium.”
Dr. Kelly Hoffman said the new version includes a provision that “violations of this policy may result in disciplinary action for employees up to and including discharge, fines and possible imprisonment,” language the committee noted properly applies to employees but not to elected board members. Hoffman explained that the state school code governs actions against elected members and that staff would consult the solicitor about how to reflect that distinction in the policy text.
Committee members also questioned the honorarium definition. The policy currently defines honorarium as payment for published works, appearances, speeches and presentations without limiting that to events related to district business. Several members asked that the definition be narrowed so that honoraria tied to district business or use of district information would be covered; otherwise the draft could be read to prohibit board members from accepting routine speaking fees unrelated to district duties. The committee directed staff to draft clarifying language and seek solicitor guidance.
