Council adopts ordinance regulating retail tobacco and vapor stores; planning commission approved measure

Mayfield Heights council on Aug. 4 approved Ordinance 2025-25, enacting codified Section 11.95.09 to regulate retail tobacco and vapor stores. The measure was approved by the Planning Commission at its June 16 meeting and was the city’s third reading.
The ordinance defines terms used for retail tobacco and vapor stores, sets location requirements, limits sales practices and establishes penalties for violations. At third reading, council approved two clarifying amendments to add a definition for “operator” and to clarify that violations may be enforced against any person or entity responsible for noncompliant activity, not only the operator.
Why it matters: the ordinance establishes local rules for new and existing retail establishments that sell tobacco and vaping products and provides enforcement tools for the city. Planning staff and the city attorney reviewed the amendments and recommended approval.
Council action: the amendment and the ordinance as amended were moved and passed by roll-call vote during the meeting.
Ending: The ordinance is now codified; enforcement and any required licensing or inspection work will follow standard municipal procedures and staff guidance to affected businesses.
