Supervisors approve pay estimate for drainage project; landowner crop-damage concerns remain

The Franklin County Board of Supervisors approved Pay Estimate No. 7 for drainage contract DD30Lab10 while keeping the project’s remaining retainage in place to cover outstanding issues, including landowner claims for rock and crop damages.
County staff told the board the contractor finished laying pipe 10 days after the contract extension expired; the contract allows up to $500 per day in liquidated damages, which would total about $5,000 for the delay. With the current payment, staff reported the county will still hold roughly $46,000 in retainage and pay the contractor $110,652 under the current estimate.
A landowner has complained that a roughly 100-by-100-foot area on his property was left with bedding material containing 3-inch-plus rock mixed with a thin layer of black dirt. Staff said the contractor offered to send a crew to remove and replace that material; if the contractor performs the cleanup, the county would not pay extra. If the county must hire another party to do the work, the cost would come out of the project retainage.
Board members and staff also discussed likely crop-damage and reduced-yield claims. Staff said such claims are typically addressed by the drainage district and assessed after crop maps and claims are submitted; the county will consider those claims at the completion hearing and during fall damage assessments.
Supervisors agreed to pay the current estimate and retain the withheld funds to cover potential cleanup, crop-damage claims and other outstanding items until the formal completion hearing.
