The Merrimack Conservation Commission discussed a draft standard letter intended to open conversations with property owners about potential land acquisitions, but deferred approval pending guidance from the town council and the town attorney.
Commission staff said the draft letter would serve as an initial, exploratory outreach tool for parcels that might be donated, bequeathed, conveyed, or considered for easement. The commission discussed risks of making such correspondence an official town document: once on town letterhead, communications can become public records, potentially alerting developers or other buyers and undermining quiet negotiations.
Commission members said the commission has historically approached some prospects informally — for example, door-knocking or leaving a business card — to avoid publicly signaling interest before price or terms are negotiated. One commissioner said that for certain parcels the commission had previously “negotiated a price quietly” and cautioned that public outreach could prompt competitive bids.
Commissioners agreed to schedule a meeting with the town council and legal staff to clarify whether a standardized town-letter approach is permissible, when communications on letterhead would become public, and what guardrails would be needed. The commission deferred action on approving the draft letter until after that conversation and possible appearance before the council.
Staff will arrange the council discussion and return the draft for commission consideration.
