The Flagler County Planning and Zoning Board on Jan. 30 approved a special-exception application to permit a home-based real-estate office at 1240 Lambert Avenue, with the board specifying the approval runs with the property owner rather than the land.
Planning staff told the board that the site is in an unincorporated subdivision with R-1B zoning, where home occupations require a special exception. The applicant, referred to in the staff report as Mr. Clark, agreed to abide by the county’s home-occupation guidelines: no on-site customers, no signage, no on-site clients because the agent will take buyers to properties for sale.
Staff recommended approval after finding the application met the special-exception criteria in the land development code (section 3.07.03(f)). When a board member asked for clarification whether the special exception ran with the applicant or the land, staff advised that, given the assurances provided by the applicant, it was appropriate to make the approval run with the applicant. The maker of the motion amended the motion on the record to state the approval “runs with the property owner and not the land,” and the board voted unanimously in favor.
The board recorded no additional conditions or follow-up tasks beyond the standard compliance with home-occupation guidelines.
