Staff had recommended denial because the original application described housing for "6 to 8 elderly residents," which exceeds the definition for a dwelling group under Ohio Revised Code section 5119.34(b)(1)(b) that the staff quoted in its report. After receiving the staff report, the applicant's architect amended the application on the record to limit occupancy to no more than five residents and clarified compliance with ORC 5119.34(b)(1)(b). Architect and applicant representatives said the interior remodeling will add ADA bathrooms and an ADA ramp; they told the board the facility will be licensed and staffed 24 hours, with one overnight employee and one to two staff for daytime shifts. The owner's representative, Segar Dittel, said the property was purchased recently and that landscaping and maintenance issues are being addressed; he told the board they plan to hire professional landscapers if the conditional use is approved. Planning staff described inspection and licensing processes: a building permit and building inspections will be required for change of use, fire and building inspections will take place during and after construction, and the state licensing agency will perform periodic unannounced inspections after operation begins. Several neighbors spoke during public comment with concerns about current exterior maintenance, the driveway surface and a deteriorated fence between properties; the board chair and staff clarified that property‑maintenance and parking enforcement issues are handled by the building department and code enforcement and are separate from the conditional‑use decision. The board approved the conditional use by roll call with five yes votes and two no votes; staff noted that the city has the authority to revoke a conditional use if conditions are violated.
