The Pueblo County Liquor and Marijuana Licensing Board on July 14 continued the renewal review for a retail marijuana cultivation license held by Colorado Leaf LLC at 8217 Red Creek Springs Road after county tax records showed no taxable events for a year.
The item was continued to the board’s Aug. 11 meeting, with board members also delegating authority to county licensing staff to approve the renewal before that meeting if the Pueblo County tax department confirms there are no ongoing inactivity concerns.
Board members said the county’s tax report dated Oct. 24 indicated 12 months without a taxable event for the license. License representative Seth Bosman told the board the business had made sales and paid taxes in the past 12 months. “We have had sales and have paid taxes in the last 12 months,” Bosman said. County staff explained the discrepancy could reflect the tax department’s reporting cutoff relative to when the renewal application was filed.
The board discussed options including referring the matter to a hearing officer or continuing it so staff could reconcile records with the tax department. Board member Sarah Habib moved to continue the item to the Aug. 11 agenda and to delegate authority to staff to grant the renewal and remove it from the agenda if there are no tax concerns; Judith Stein seconded the motion. The board voted unanimously in favor.
Staff told the board that if the tax department shows the initial flag was an error, staff could administratively grant the renewal without bringing the item back to the board. If the tax data confirm a 12-month inactivity gap followed by sales, staff will return the matter for board consideration.
The board noted that it has discretion to define inactivity and that taxable-event checks are an administrative way to flag licenses for review. The board’s next meeting is Aug. 11 at 5:30 p.m. in the Commissioners’ County Chambers.
