Bill Sweet, the town administrator, described the agreement as "the contract for the South End sewer project, as designed by Otter Creek Engineering." The board met in executive session for attorney-client communications before returning to the public meeting to complete the vote.
The contract calls for monthly progress payments based on applications from the contractor measured against a schedule of values, with retainage provisions that effectively withhold about 10 percent until the work reaches the milestones described in the agreement. Sweet told the board the most costly line items are front-loaded, notably boring work, so early invoices will be larger and will carry standard retainage. The board agreed the chair may sign the contract tonight but that the contract will not be sent or fully executed until town council and town counsel have confirmed final language.
Select Board members said they had forwarded comments from the town attorney for incorporation and asked staff to confirm those revisions were included before final submission. The motion to authorize the chair to sign passed 5-0. The board also asked staff to retain copies of insurance and accident-related correspondence for the town files and the League of Cities and Towns.
The action starts procurement and construction steps for a project engineered by Otter Creek Engineering and, according to town staff, will include trenching, boring, and other utility work needed to extend sewer service in the town's south end. The board said it expects the project schedule and payment requests to be monitored closely and that disputed or deficient work will be handled through retainage and punch-list procedures until final completion.
