The Grand County Housing Authority, meeting as that body during Tuesday's session, approved an exemption to the Coyote Creek restrictive covenants for Samuel D. and Lynelle L. Sparks for Lot 23, Unit 12. Housing authority staff said the exemption falls under section 2.1 of the covenants, which exempts transfers by first-time purchasers when a developer conveys land to an individual who will construct a residence to sell to a third party.
Staff said the item is a name-change from a prior approval for the same buyer when the purchase had been under an LLC; the lender required the buyer take title in their personal names. The board first moved to rescind the earlier resolution (2025-6-11) and then approved a new resolution with the corrected names so the county's records would match the transaction.
The motion to rescind and then approve the revised exemption passed on voice vote. Housing authority counsel confirmed the action would generate a new resolution with a unique number reflecting the corrected buyer names.
