Board issues declarations for resolved sign violations; no fines imposed

Aug. 28, 2024 — The Municipal Code Enforcement Board received reports from sign inspectors that several sign‑code violations had been corrected before their scheduled hearings and entered declarations of violation for those cases without imposing fines.
Stephen Burger and Stephen Burkhart, sign inspectors with the city of Clearwater, presented multiple cases — including 102‑24 (1141 Court Street), 103‑24 (1822 Drew Street), 104‑24 (411 East Shore Drive) and 105‑24 (4490 Poinsettia Avenue / SCI Pelican Walk LLC) — and told the board the violations were corrected prior to the hearings. In each case the inspectors recommended a declaration of violation and no fine.
"The violation was corrected prior to today's hearing and to enter an order that no fine be imposed," Stephen Burger told the board when presenting one of the matters.
Board members approved each declaration. The standard order the board entered noted that if a respondent repeats a violation the board may impose fines of up to $500 per day for each day a violation continues.
The declarations are procedural findings that an infraction occurred but that the city will not levy a fine in these instances because the property owners corrected the violations before the hearing. Inspectors told the board they would continue to monitor for repeat violations.
