The Town of Saint John Plan Commission on July 30 approved the primary plat for Castle Rock Phase 3 and granted a waiver from the town—s additional pipeline exclusion-zone requirement, subject to a requirement that building setback lines be adjusted so structures will be no closer than 50 feet from the pipelines themselves.
Developer representative Doug Redig said the property contains multiple pipelines and extensive wetlands that constrain lot geometry. The commission considered a formal waiver from an ordinance change that had required an additional 50-foot setback beyond pipeline easement lines. Redig said the developer had provided building lines and easement adjustments that put most buildings 40 to 50 feet from the pipelines; pipeline owners had not objected to the plan.
Commissioners expressed concern about setting a precedent and sought a compromise. Commissioner Abernathy moved to approve the primary plat while limiting the waiver so required building lines would ensure at least 50 feet from the actual pipeline centerline rather than from the edge of the recorded easement; Commissioner Bamick seconded. The motion passed on a recorded voice vote recorded as approved.
Town staff confirmed the development will follow pipeline-owner requirements for utility crossings, cover, and construction near pipelines, and that road and utility crossings will be coordinated with pipeline owners. Redig said he will adjust the primary-plat building lines and those adjustments will be reviewed again at final plat.
No physical construction was authorized by the plan commission vote beyond the approval of the primary plat; final plat and construction permits remain subject to final reviews, pipeline-owner approvals, and town engineering clearance.
