The Jefferson County Board of Zoning Adjustment on July 28 approved a variance permitting an accessory structure to remain in front of a newly constructed residence on property owned by Paul and Megan Pence. Staff said the property is in EMF (State Minted Farms) zoning and the accessory structure predates the primary residence, making it an existing nonconforming structure.
Staff explained that county regulations (Section 1001.04) set location and setback standards for accessory structures and that, while essential structures are normally required to be located to the rear of the primary residence, the accessory structure in question sits approximately 109 feet from the road right-of-way and is not expected to be out of character with the surrounding area. Staff recommended approval.
There was no public comment on the item. A board member moved to approve case A250022, another seconded, and the board voted to grant the variance. The approval allows the Pences to proceed with repairs to the accessory structure in its current location, subject to any standard permitting requirements.
