Commissioners debate limits on outgoing officials' authority to buy, sell or trade equipment; workshop planned

The Van Zandt County Commissioners Court discussed proposed changes to its "lane conduct" policy intended to limit actions by incumbents who are not renominated or reelected (so-called "lame duck" officeholders), particularly relating to major equipment purchases, sales or trades. Commissioners described recent situations in which equipment purchased or later sold by outgoing precinct officers left successors with gaps in capability and potential unrecoverable losses. Commissioners proposed clarifying that certain actions'including selling, trading, leasing or otherwise disposing of heavy equipment'should be prohibited once an officeholder is not renominated or not reelected, except in emergency situations approved by the court. The county attorney and staff said the Local Government Code allows the court to set a threshold (percentage or dollar amount) requiring court approval for spending by incumbents after election results are known; the court may also adopt additional restrictions. Commissioners agreed to collect sample language and hold a workshop to craft clear policy text defining the lame-duck period, permissible emergency exceptions and thresholds for required approvals. No formal amendment was adopted at the meeting; the item was tabled pending a future workshop and draft language for the court to consider.
