A City of Daytona Beach special magistrate on May 13 vacated a prior order imposing a $15,000 fine against Social Daytona Incorporated, and waived the recording fee and interest associated with that lien.
The magistrate announced the ruling after city staff told the court the parties had reached an amicable resolution tied to ongoing litigation and appeals. The vacated order was SMG042480 (effective April 12, 2024), for which the city earlier had sought enforcement; the magistrate’s action removes that specific $15,000 lien.
City counsel explained the decision to seek vacation of the order was part of a negotiated settlement in which Social Daytona had vacated the premises and litigation related to criminal charges and civil enforcement had been resolved in ways that made vacating this particular lien appropriate. The magistrate confirmed he would vacate the prior order and waive the recording fee and any interest connected to it. “I am vacating the previous order imposing fine and lien effective 04/12/2024 in the amount of $15,000,” the magistrate said on the record. He also confirmed waiving the recording fee and interest.
City staff noted that other fines and liens related to Social Daytona matters remained in place and that this action addressed one specific case record. Counsel told the magistrate the parties had agreed to the terms and that the resolution would not reallocate other outstanding obligations.
The magistrate signed the order vacating the April 12, 2024 determination and relieving Social Daytona from that specific $15,000 fine and associated recording fee and interest.
