The Jacksonville Beach Planning Commission on July 28 unanimously approved a conditional-use application (PC 12-25) allowing the continued operation of a gasoline service station and convenience store at 1403 Third Street North.
Planning staff said the property, located on the northeast corner of Third Street North and Thirteenth Avenue North, has operated as a gasoline service station since its original construction in 1983 and that it had not previously been issued a conditional-use approval under the city's new land-development code. Staff recommended approval and explained that, if approved, the conditional use may transfer to future operators or owners unless a substantial change to the use or site occurs.
Applicant Jeff Frank, who identified himself at the hearing and said he and his group purchased the property in February 2023, told the commission they were unaware the CUP was required at the time of purchase and apologized for the oversight. Frank said the site currently operates with a convenience store tenant and a separate secondary tenant space; staff clarified the restaurant/tenant space is a separate existing use and not part of the CUP request for the gas station itself.
Planning staff noted the station has operated for decades without creating a long-term nuisance and that a prior code-enforcement matter related to a rear tenant had been resolved. The application materials and staff analysis found adjacent uses include multifamily housing to the east and various commercial sales and offices along the block; staff concluded the continued use is compatible with surrounding development and recommended approval.
At the public hearing there were no speaker cards and no public testimony. The motion to approve passed on a roll-call vote with Commissioners Margot Moring, Debbie Cole, Justin Henderson, Dean Haddock and Nicholas Andrews all voting yes. There were no conditions attached to the approval beyond those required by code and standard city permitting for gas stations and convenience stores.
Ending: The conditional use now authorizes continued fuel service and convenience-store operations at 1403 Third Street North under the current code. Staff advised that any substantial change to the site or use would require a new application to the planning commission.
