The Haysville City Council voted to approve a conditional-use authorization for a vehicle storage yard in Lot 1, Block C, Haysville Industrial Park while noting the applicant has told staff it intends to operate a construction sales and service business instead — a use allowed under the property’s light industrial zoning.
City planning staff told the council the planning commission recommended approval of the conditional use at the May 22 hearing, with specified conditions; one condition listed in the staff memo was removed because the city currently lacks an ordinance authorizing administrative revocation of a conditional use. Staff said the applicant informed the city on the day of the council meeting that the intended use would be construction sales and service, which does not require a conditional use in the light industrial district.
Council members pressed staff on how the city would prevent the vehicle-storage yard from becoming a vehicle repair operation. Councilman Crump asked what enforcement leverage the city would have if trucks stored on the property began to be worked on regularly. Planning staff responded that the city’s zoning definitions govern permitted uses, and that vehicle repair is a defined use in the code. The staff explanation noted that routine maintenance on vehicles owned by the property operator would be incidental, while repairs to vehicles not owned by the operator would be vehicle repair and would typically require a business license and be subject to environmental and building inspections.
Staff recommended the council approve the conditional use with the conditions in the memo “to protect the applicant in case he doesn't expand his business model” to sales and service. Approving the conditional use would allow the property to operate as a vehicle storage yard if the applicant did not proceed with the construction sales and service plan; if the applicant uses the property for a permitted use in the light industrial district, no further action would be required.
Council approved the resolution after a motion and second. The roll call showed one “no” vote (Councilmember Hart) and the remainder of the council voting in favor.
