Council finds good cause to not renew Fresh Organic LLC marijuana licenses

By unanimous vote the council approved resolution CR73, which documents the council’s July 14 hearing findings and cites the licensee’s lack of entitlement to the licensed premises and failure to seek a continuance as grounds for nonrenewal of Fresh Organic LLC dba Fresh Cannabis’ medical and retail marijuana licenses.
The City Council on July 28 approved a resolution documenting findings of fact and formally recording the council’s decision to find good cause for nonrenewal of Fresh Organic LLC’s medical and retail marijuana licenses.
City Attorney Hoffman said the findings summarize evidence presented at a July 14 hearing. The undisputed record showed the licensee did not have an entitlement to the licensed premises, and that lack of possession is a ground for nonrenewal under the city’s licensing rules, Hoffman said. He also noted the licensee did not seek a continuance after failing to appear at the hearing.
"This findings of fact attempts to summarize the evidence you heard on 07/14/2025, and under the city's process to make those the findings of fact that result in nonrenewal," Hoffman said.
Council opened the vote and CR73 passed unanimously. Hoffman said the findings will be provided to the licensee and forwarded to the state to reflect council's determination of good cause for nonrenewal.
