KD Food Mart owner fined after second flavored-vape violation; suspension deferred pending repeat offense

On July 28, 2025, the Fall River Board of Health affirmed enforcement action against KD Food Mart, 208 Stafford Road, finding the business in violation for selling or possessing flavored vaping products in contravention of Massachusetts law. The store paid a $2,000 fine for a second violation after a reinspection found flavored vapes in an open box in the storage area.
Board staff Jennifer said she performed an inspection on March 28 and found flavored vapes; a cease-and-desist and a $1,000 fine were issued then. On a July 14 reinspection Jennifer reported finding a box of flavored vapes in the store's storage area; she said, "Since it was their second violation, I sent another cease and desist, issued a fine for $2,000." The proprietor, who identified himself as Mizan Rahman, said the presence of the 5% flavored items was unintentional and attributed it to a wholesaler shipment; he offered to show invoices.
The board maintained the fine, accepted payment, and—following recent practice—declined to impose the seven-day suspension, instead warning that a third violation would result in a 30-day license suspension. Board members recorded a roll-call vote affirming the action. The business removed the flavored products and told the board they understood the next violation would carry a longer suspension.
