St. Joseph County staff recommended that the council approve 10 compliance reports tied to tax abatements after reviewing submitted CF-1 forms. The county’s controller briefed the committee on the process for abatement compliance reviews and said staff had reviewed thousands of pages of documentation.
"Each company sends in a CF-1 form that says we did or we didn't do what we promised we would do," staff said, explaining that council review provides an opportunity to authorize the council president to sign CF-1 forms when it finds substantial compliance.
Staff noted that in past practice the council has rarely revoked abatements; instead it has required corrected paperwork when filings were incomplete. Two of the properties in the current packet do not yet have assessed value and therefore their abatements would not yet start. Staff recommended the committee move the reports to the public hearing for a voice vote.
Council members asked questions about particular companies' filings and about limited disclosure of some affirmative-action or proprietary materials; staff explained those records were handled according to federal trade-secret rules and previous waiver requests.
The committee did not vote on the abatements at the meeting; staff advised the matter will be presented at the upcoming public hearing, where the council will take a voice vote on each CF-1 and instruct the president to sign when in compliance.
