The Vallejo Code Enforcement Appeals Board on a public hearing upheld the second administrative citation for 709 Admiral Callahan Lane, directing continued enforcement until the property owner complies with Vallejo Municipal Code section 7.54.030.
Staff presented a timeline of inspections and notices showing repeated graffiti, trash and debris and fence and gate disrepair. James O'Brien, code enforcement officer, told the board that after an initial warning in August 2024 staff issued successive notices and first and second administrative citations when conditions persisted. O'Brien said he conducted a reinspection the morning of the hearing and observed “junk and debris, more graffiti on the buildings, the gates in disrepair.”
The nut of the board’s decision was that violations had recurred within 12 months and had not been fully abated despite warnings and extensions. O'Brien and other staff described a pattern of repeated graffiti and new reports from residents, and noted staff had granted deadline extensions for personal reasons but still found outstanding violations on reinspection.
Appellant Hadar Weitzman, who identified himself as the agent for the owner (Oriam Ventures LLC), told the panel he had abated many items and provided photographs showing work done “before Christmas.” Weitzman said vandalism and new graffiti repeatedly reoccurred and that he had been out of town for medical reasons. “We fixed them before Christmas,” Weitzman said. “The graffiti was very quickly the vandals came again and painted new graffiti … we did fix everything, including the graffiti.”
Board members pressed Weitzman on ongoing maintenance. A board member observed that even if one violation is abated, other distinct violations (for example, graffiti vs. overgrown vegetation) can remain and keep the case open. The board also noted the location’s visibility and repeated resident complaints as factors supporting continued enforcement. One board member suggested Weitzman formalize biweekly maintenance and document the work; O'Brien had earlier recommended a “nuisance maintenance” arrangement with on-site checks every two weeks.
Staff identified the second administrative citation amount for the 709 site as $2,386.88 (packet page 135); staff also said the citation had been paid and would be refunded if the board overturned the citation. After discussion, a board member moved to uphold the second administrative citation and direct continued enforcement until compliance; another member seconded the motion. A roll-call vote recorded Chairperson Tennyson, Vice Chair Schultz, Board Member Cavalli, Board Member Taylor and Board Member Ureta as approving; the motion passed unanimously.
The board’s action upholds the citation and leaves enforcement authority in place until staff confirm full abatement. If the appellant demonstrates sustained compliance, the board or staff may close the case per applicable procedures.
Ending: The board’s order continues enforcement and the file will remain open until staff verify complete remediation of the listed violations.
