Court resets deferred-adjudication case for Lewis Alec Martinez for restitution hearing Aug. 21

Lewis Alec Martinez appeared in Bexar County court on an application for deferred adjudication; the judge deferred a finding of guilt and reset the case 30 days for a restitution hearing on Aug. 21. The state reported restitution to named victims was proposed in the plea and defense said the defendant made upfront payments totaling about $1,200.

At the hearing, Martinez confirmed he reviewed his application for deferred adjudication and the indictment with counsel. The judge explained the possible state jail felony range for the offense charged and the consequences if deferred adjudication were later revoked. The plea papers recommended deferred adjudication with zero fine, restitution to named individuals, community supervision terms and educational courses.

Defense counsel stated Martinez had made upfront restitution payments of roughly $1,200 (approximately $300 to each of four named individuals) and asked for a restitution hearing so the court could confirm the total owed; the court granted a 30-day reset and scheduled the restitution hearing for Aug. 21. The defense also asked the court to consider transfer of probation if Martinez’s employment required residence in Tarrant County; the judge indicated that transfer could be addressed if probation was ordered.

The court emphasized that if restitution remains outstanding the issue will be addressed at the reset date and directed the clerk to set a 30-day reset for the restitution matter.
