The Nantucket Conservation Commission on July 24 approved an order of conditions permitting an addition to an existing cottage and a Title 5 septic upgrade at 16 Codfish Park Road, voting 6–0 with Commissioner Linda Williams recused.
The commission granted a waiver under the town's wetlands regulation (cited in the meeting as 390-3h3b), finding that the project area is separated from the coastal dune by a publicly traveled vehicular access way and that the proposed design avoids adverse impacts to the resource. Will, a conservation commission staff member, read the conditions on the record, including requirements for native restoration plantings, controls on fertilizer and agricultural chemicals, directing roof runoff to a subsurface infiltration system, and lighting standards.
The project, presented by Brian Madden of LEC, places the proposed addition on the landward side of the existing cottage and replaces a stone patio and retaining wall. The septic work replaces a leach pit with a Title 5-compliant system located between the road and the structure. Madden said the location chosen for the septic is the only viable spot on the parcel and that the redesign represents an improvement over existing conditions.
Commissioners discussed the waiver standard before voting. Chair Seth Engleboer and several commissioners said the addition is small and the septic upgrade provides environmental benefit. Commissioner Tim Bridal urged caution in applying the public-access waiver broadly for coastal dune resources, noting the regulation's language is discretionary. Several commissioners said the proposal moves development further from the dune and were satisfied the design avoids material adverse impacts.
The commission's motion to approve the amended order of conditions passed by roll call: Mike Mizzarelli, Arjun (RJ) Turcotte, Joe Plandowski, Tim Breen, John Schaefer and Chair Seth Engleboer voted aye; Linda Williams recused. The order includes standard construction and post-construction conditions described on the record.
The commission directed staff to finalize the written order with the conditions read into the record and to post the final document with the meeting packet.
