Council, staff and park board debate a draft resolution clarifying parks’ contracting and personnel authority

City staff presented a draft resolution that would clarify the Municipal Park Board’s authority to enter into certain contracts and to operate within city procurement and personnel policies. The draft grew out of years of local practice and a desire by staff and the park board to codify day-to-day operating authorities.

City Attorney Patrick (identified in the meeting) described the legal background, noting the city’s charter history and prior state opinions concerning park-board authority. He recommended attaching a standard form contract as an exhibit so the council would adopt the contract format the park board could use, reducing the risk that an unapproved contract could bind the city. The staff presentation also traced changes to the charter language over time and highlighted the need to clarify the definition of “parkland” and the consultation process for disposition of real property.

Council members and the park board raised concerns about oversight, budget authority and legal risk. Several council members said they were reluctant to extend any authority that could let the parks incur indebtedness or enter into contracts that exceed charter limits without council review. One council member said she was uncomfortable ceding additional authority because council members are elected to oversee city finances. Staff and the park board said they seek only to codify how they have been operating, with standard constraints, and asked for clearer guidance on which contracts would nevertheless require council approval.

Council requested a joint meeting with the park board to resolve outstanding questions, asked staff to include a report-back on any contracts entered under the authority and sought language that would ensure budgetary limits and contractual safeguards. The council did not vote on the draft resolution at the meeting; members asked for more time and a follow-up joint session.
