The council approved Resolution 2025-30, allowing the sheriff to sell unclaimed or confiscated firearms in accordance with state law and to direct proceeds to the county general fund for public interest use. The resolution passed after the council suspended rules and approved by voice vote.
The Cache County Council voted Tuesday to approve a resolution governing the disposal of unclaimed or confiscated firearms by the Sheriff’s Office and the disposition of proceeds.
Under state law, the sheriff may transfer firearms no longer needed as evidence to federally licensed firearms dealers. Resolution 2025-30 authorizes the sheriff’s department to sell such firearms and directs proceeds to the county general fund for public-interest uses, rather than retaining the funds within the sheriff's office budget. Staff said this aligns accounting and removes a standing internal invoice practice.
Council members asked how often such sales occur and whether the sheriff maintains standing contracts with Federally Licensed Firearms (FFL) dealers. Staff said the volume of saleable firearms is low and that the sheriff typically uses standing arrangements with licensed dealers for bulk sales. The council also discussed that many recovered items are not saleable and instead are destroyed or scrapped.
A motion to suspend the rules and approve Resolution 2025-30 was made, seconded and approved by voice vote.
