For delinquent recycling and trash accounts, staff cited Kansas statute (as stated in the meeting, "KSA 60 five‑thirty 4 10") authorizing cities to assess delinquent recycling and trash fees and recommended holding the required public hearing on the same date, Aug. 12, 2025 at 7 p.m. Council approved the hearing date by motion, 7–0.
During discussion, a councilmember asked whether the city could suspend optional trash service for a delinquent account; staff said they would research the question. Staff noted that recycling is mandatory and had been billed automatically to the property in question while trash accrued because the property owner had signed up for trash service and then failed to pay.
Why it matters: If approved after the public hearing, the listed delinquent amounts will be assessed to properties and submitted for county assessment in time for the August deadline.
Next steps: Staff will mail notices to property owners at least 10 days before the hearing, present the report at the Aug. 12 hearing, and then, if council approves, adopt a resolution to place the assessments on the county tax roll.
