Board awards Columbus Avenue reconstruction bid to 3 D Company after low bidder found ineligible

The Muncie Board of Public Works and Safety voted Jan. 8 to award the Columbus Avenue reconstruction contract to 3 D Company after the apparent low bidder, JG Case, was found not to be INDOT-prequalified for public road work.
Adam Leach, city engineer, told the board that the low bid from JG Case — $2,379,068.10 — was discovered during due diligence to come from a firm that was not "INDOT prequalified, which is a requirement per Indiana Code Title 8" for public road work contracts over $300,000. He said the next-lowest responsive, prequalified bidder was 3 D Company, at $2,394,000, and recommended awarding the project to that firm.
"There is a requirement for those doing public road work in the state of Indiana for contracts over $300,000 to be INDOT prequalified," Leach said during the presentation. He told the board the city and its counsel had reviewed the procurement and confirmed the prequalification requirement applied to this project.
Board members moved and seconded a motion to award the contract to 3 D Company; the motion carried on a voice vote.
The award means work on Columbus Avenue will proceed under the lowest responsive, INDOT-prequalified bid. The board did not provide a recorded roll-call tally in the meeting transcript; three members were present for roll call earlier in the meeting. The board also noted that the legal review and procurement files reflected the city’s due diligence in resolving the bid irregularity.
The board did not discuss a construction start date or project phasing in this session. Additional contract documents and scheduling will be handled through the city engineer’s office and the city’s contract execution process.
