Supervisors permit temporary authorization to transfer old jail lease pending town approval

Botetourt County supervisors authorized staff to allow the transfer of the county’s old jail lease from current lessees to a prospective new lessee, subject to conditions.
County administrator Gary LaRoe told the board that the old jail is currently leased to Carden Enterprises (Don and Caroline Naismith) under a 40‑year lease signed on Jan. 16; about 38 years remain on the term. Prospective lessees identified as Mr. and Ms. Lambert asked the board to permit transfer of the lease to an LLC they would form. LaRoe said the Lamberts seek up to 120 days to establish an LLC, finalize a business plan, obtain Town of Fincastle approval required by the lease, and complete other due diligence such as utility transfers.
LaRoe recommended that the board grant conditional authority to transfer the lease for up to 120 days; if conditions are not met within that window the transfer authorization would expire. He also requested authorization for the county administrator to sign the new lease once the town and other approvals are complete. The board approved the request by motion and second; no opposition was recorded.
The prospective use described at the meeting included potential commercial operations such as a coffee shop or gallery, but any use would require local approvals. County staff said the transfer would convey the remaining lease term and conditions to the new lessee if all conditions are satisfied.
What happens next: the prospective lessees have 120 days to form an LLC, obtain Town of Fincastle approval as required by the lease, complete utility transfers and meet other stated conditions. If the requirements are satisfied, the county administrator will execute the lease transfer.
