Board seeks to comply with new level 2 volunteer-screening law; staff to advertise related policies next week

Board member Ms. Hill asked July 22 whether the district is in compliance with a new law that requires Level 2 background screenings for some volunteers. The board attorney replied that the law has had delayed implementation and that while the district has made preparations, not all volunteers have yet had Level 2 screenings.
The attorney explained that the state law gives public entities discretion: a public entity is not required to conduct Level 2 screenings for all volunteers but, if it chooses to implement them, the district must follow defined steps. The attorney also noted that certain non-instructional contractors may be excepted when working under direct supervision of instructional personnel.
Ms. Hill said she had read the law and believed it became effective and enforceable on March 1; she urged the district to move toward compliance to avoid future liability. The board chair and staff agreed the board intends to be in compliance and said the district will bring multiple policies for advertising next week addressing Level 2 background screenings.
No formal policy was adopted at the July 22 meeting; the board was asked to approve advertising of policies at the next meeting. The attorney and staff framed the current status as preparatory and noted that full implementation will take time because of background-check processing and fingerprint database issues referenced in the attorney’s explanation.
