The Fall River Historical Commission voted July 22 to complete a Certified Local Government (CLG) eligibility opinion form supporting a National Register of Historic Places nomination for the Night Owl diner at 1680 Pleasant Street.
Commissioners approved a motion to fill out and forward the required CLG opinion form to the Massachusetts Historical Commission so the state can take up the nomination. The vote followed staff explanation of the process and a review of how the state evaluates National Register nominations from CLGs.
Commission discussion noted that National Register nominations evaluate properties “as they exist” and that the state review depends on current conditions and documentation, including a photographic survey and a form B historic-resource report. Commissioners discussed a proposed rear addition shown in architectural drawings and the potential for a large addition to affect the diner’s historic character; members said that the National Register process evaluates existing conditions and that the state review would address whether any planned additions are compatible. The commission did not object to the nomination as submitted; it voted to provide the CLG eligibility opinion that documents the commission’s professional assessment for the state.
Why it matters: inclusion on the National Register can be a prerequisite for state historic rehabilitation tax credits. The commission’s CLG opinion is part of the administrative record the Massachusetts Historical Commission considers before the state proceeds with the formal review and any tax-credit scrutiny.
