Judge keeps probation in place and orders special-needs treatment for woman charged with robbery

A Jefferson County judge on July 17 declined to revoke probation for Marissa Tibbetts and instead ordered her to enter and successfully complete the Special Needs Safety program, a court-ordered treatment and monitoring track intended to address mental-health and substance-use needs.
Tibbetts faced a first-degree aggravated-robbery probation violation and an allegation of burglary of a habitation; the court heard that the burglary allegation had an indigent complainant and that direct evidence was not presented at the hearing. The court found tracked violations of positive drug tests and missing fees to be of present concern, but said that the Special Needs Safety program would provide supervision, treatment, and aftercare.
Defense counsel and probation staff said Tibbetts had some stabilizing factors, including periods of employment and an expressed willingness to complete treatment. The judge ordered continued probation, required enrollment in Special Needs Safety, and warned that failure to comply could lead to revocation and prison exposure.
The court asked probation staff to prepare an updated pre-sentence report for any future disposition if additional allegations proceed to indictment; Tibbetts was instructed to cooperate with program placement and aftercare planning.
