Council approves one-year moratorium on permits for dwellings built to non-Florida codes to allow LDR updates

Lake City — The City Council on July 21 adopted a one-year moratorium on accepting and processing applications for dwellings constructed to codes other than the Florida Building Code so staff can revise the Land Development Regulations (LDR) to clarify definitions and inspection requirements.
City staff explained the moratorium will pause new installations of manufactured housing built to HUD standards (commonly called manufactured homes) versus modular homes built to different codes, and permit staff time to prepare clearer LDR language defining manufactured, modular and true mobile homes. “The moratorium is putting a hold on new manufactured homes and that coming into the area; [it] allows staff [a] chance to update the LDR,” Mister Angelo said. He and others described confusion in the code between HUD-built manufactured homes and modular homes built to other standards.
Staff clarified the LDR update will focus on defining homes by the codes to which they were built rather than by construction year; the city intends to add inspection standards so the building official can inspect a used home before it is moved into the city. “One of the provisions…is that the building official will have to go out and inspect it before it's allowed to come into the city to make sure it meets the flow code and everything,” staff said during the discussion.
Council members asked whether the moratorium would be lifted once the revised code is adopted; staff answered the moratorium would be lifted as soon as the LDR changes are adopted. Councilmember Jernigan and others said they support the measure, citing an influx of older, used mobile homes seeking placement and the need to protect life-safety standards.
A motion to adopt ordinance 2025-2316 passed by unanimous roll call. The ordinance declares a one-year moratorium on acceptance and consideration of land-use actions or permits for dwellings built to codes other than the Florida Building Code and directs staff to return with draft LDR language. Council requested staff aim to complete the draft quickly and to present it for council consideration before the moratorium expires.
