Residents raise concerns over building permit, rezoning notices and pending litigation around 1604 Hickory Avenue

During the July 17 public‑comment period, residents raised questions about a building permit and a rezoning application tied to 1604 Hickory Avenue and about whether required notifications and signage were posted.
Carol Barker LaGreco said she reviewed City Hall records and found an application related to a building permit on a “substandard lot” but no record the council had acted on the site’s permit as required under the city’s ordinances. LaGreco told the council she saw evidence of construction — a poured foundation and driveway work — and that the matter is the subject of filed litigation.
City Attorney Scott Stansbury and the mayor told the public the council could not discuss the matter at length because the issue is in litigation. LaGreco offered to submit exhibits to the clerk for the record.
Residents also asked about a separate rezoning item scheduled for Planning & Zoning review on Aug. 6. Council staff said notices to property owners within 300 feet would be mailed July 23 and that required sign posting is expected in the three weeks before the hearing; the clerk said the full ordinance text and packet are published on the city website.
Several council members said staff should confirm the mailed notice and sign dates before Planning & Zoning acts so the commission does not consider an item without required procedural notices. The council agreed staff would verify signage and mailing dates and reschedule consideration if the required procedures had not been followed.
The council had introduced several ordinances for first reading related to building permits and rezoning (addresses and ordinance numbers were on the meeting packet). Planning & Zoning is scheduled to review those items on Aug. 6; any recommendation from that commission would then return to the council for final action.
