Committee approves developer agreement and stormwater maintenance plan for Smyrna forensic center, sends both to full commission

Eric Hennessy, county staff, asked the Public Works Planning Committee on July 16 to approve a development agreement with the Town of Smyrna to enable grading, utility connections and stormwater coordination for the county’s forensic center project.
Hennessy said the agreement is a standard municipal developer agreement modified to remove items unrelated to the county’s work; it covers water, sewer and stormwater facilities the county will connect to in Smyrna. He told the committee that Smyrna has waived some fees already (including a plans-review fee of about $3,010) and that negotiations continue on roughly $75,000 of additional fees. Hennessy said those fees and credits are covered within funds already appropriated for the project (he cited $19,100,000 appropriated by the commission for the project).
Committee members discussed schedule sensitivity and cost risk. Hennessy said the contractor (RC Matthews) has estimated general conditions equal to about $21,000 per week, and that construction delays would raise total costs. County staff and the mayor’s office had met with Smyrna officials, Hennessy said, and the town had agreed to reduce or waive a number of charges to facilitate timely permitting.
The committee voted to approve the development agreement and to send it to the full county commission for consideration at its next meeting. Roll-call votes were recorded: Commissioner Boyd — yes; Commissioner Dodd — yes; Commissioner James — yes; Mr. Piercy — yes; Commissioner Kush — aye; Chairman Johnson — aye. The motion passed.
The committee then considered a separate long-term stormwater maintenance plan and agreement tied to the same forensic center project. Hennessy said the county already inspects and maintains comparable county-owned stormwater facilities and that the primary additional requirement was to share inspection reports with the Town of Smyrna. Committee members agreed the maintenance arrangement formalizes work the county already performs.
The committee voted to approve the long-term maintenance plan and to send it to the full commission for approval. A roll-call vote was recorded: Commissioner Boyd — yes; Commissioner Dodd — yes; Commissioner James — yes; Mr. Piercy — yes; Commissioner Kush — yes; Chairman Dodson — aye. The motion passed.
Hennessy and staff said they will continue negotiating remaining municipal fees and will provide updated line-item figures to the commission; they also noted that some fee credits may be available once the county submits final roadway improvement plans to Smyrna for review.
