BZA approves transfer of Mutts Place conditional‑use permit to new LLC; operations unchanged

The Board of Zoning Appeals approved a transfer of the conditional‑use permit for the private‑club use at 263 Beechhurst Avenue (Mutts Place), allowing the business operation to move from the current business entity to Hot on the Trots LLC.
Eli Martinez, who identified himself as general manager and the buyer/operator representative, told the board he is purchasing the business but not the building and that he expects no changes to hours, menu or the structure: “There will be no changes. It's the name of the bar will continue to be Mutts Place. The hours of operation will stay the same. The menu will stay the same,” Martinez said. He said he has been managing the establishment since 2022.
Planning staff explained the original conditional‑use approval (CU13) had a specific condition that the conditional use was granted to Mutts Place Incorporated and would require BZA approval before transferring to a different owner. Because the proposed change is only an ownership transfer and the use will remain a private club, staff recommended approval. The board accepted the findings of fact and approved the transfer with no additional conditions.
The board noted the decision is appealable to the Circuit Court of Monongalia County and that any work undertaken during the 30‑day appeal window is at the new operator's financial risk. Planning staff said written confirmation would be sent to the applicant.
